Short answer: yes on most serviced urban lots. Milton allows one detached ARU, needs a building permit, and requires every ARU to be registered.

Short answer: Yes, on most urban Milton lots with municipal water and sewer. The Town allows up to four units per eligible property, only one of them in a detached building. You need a building permit first, and once construction is complete you must register the unit with the Town (Town of Milton).

Who can build one

  • Urban lots: residential properties with municipal water and sewer that contain a detached house, semi-detached house, semi-link house or townhouse. Stacked and back-to-back townhouses are excluded.
  • Unit count: up to four units including the primary dwelling, and only one ARU in a detached building.
  • Unserviced urban lots: in a low density residential zone without municipal water and/or sewer, up to two ARUs may be permitted, subject to requirements.
  • Condominiums: check with the condominium corporation for extra restrictions.

Rural Milton

In January 2026 the Town updated its Official Plan and Zoning By-law to permit ARUs in some rural areas. Outside the Niagara Escarpment Plan Area, RV and C4 lots may have one ARU, including in an accessory building. Inside it, detached ARUs are not permitted. In the Greenbelt Natural Heritage System ARUs are not permitted, and A1 lots outside the Greenbelt Protected Countryside may have up to two ARUs, only one of them detached (Town of Milton).

Zoning

The Town's zoning by-laws set where the unit can go, its size, parking, and where detached structures can sit. We check those standards for your zone on the survey rather than quote a town-wide figure. If a design misses a standard, the Town says a minor variance may be possible.

  5. Register the ARU with the Town once construction is complete, then renew as the program requires (register an ARU).

FAQs

Often, yes. The Town permits additional residential units (ARUs) on urban residential properties with municipal water and sewer that contain a detached, semi-detached, semi-link or townhouse dwelling (not stacked or back-to-back townhouses). Not every eligible property can fit one.
