Milton

In Milton, servicing sets the ceiling — and registration is mandatory.

Two things decide a Milton backyard build, and neither is the design. First: if your property has municipal water and sewage servicing, Milton permits up to three additional residential units — four residential units in total on a lot with a detached, semi-detached or townhouse dwelling. Second: since 1 April 2025, every ARU must be registered with the Town, at a one-time fee of $340 per ARU. Most owners have never heard of that step.

Milton calls it an ARU — and that includes garden suites

Milton's official term is Additional Residential Unit (ARU). That is not a near-match you have to argue for: the Town's own definition explicitly names garden suites, alongside coach houses, laneway houses, basement apartments, secondary suites and tiny homes. So the Town's ARU page is your rule set, even though "garden suite" is what you typed into the search bar.

The urban permissions took effect 25 June 2024. Anything you read about Milton backyard units written before that date is describing a different by-law.

The servicing gate, and the four-unit ceiling

This is the fact that shapes every Milton conversation we have. Where the property has municipal water and sewage servicing, and the existing dwelling is detached, semi-detached or a townhouse, Milton permits up to three ARUs — a total of four residential units on the lot.

If you are on well or septic, do not read the four-unit figure as yours. Rural Milton is being worked through separately, and a rural or agricultural property should not assume the urban rules apply. We will tell you which side of that line your address sits on before you spend anything on drawings.

Registration: the $340 step nobody mentions

Since 1 April 2025, new and existing ARUs must be registered with the Town of Milton. You can do it in person at Town Hall or online. The registration fee is a one-time $340 per ARU.

Two things follow from that. One: registration is a separate obligation from your building permit — finishing construction is not the end of the file. Two: the "existing" wording matters. If there is already an unregistered unit on your property, adding a backyard suite brings the whole lot into view.

What Milton does not publish — and what we will not invent

Milton does not publish detached-ARU setbacks, maximum height, maximum floor area, lot coverage or parking on its ARU page. Those come out of the Milton Zoning By-law for your specific zone, which is exactly what the lot check pulls. We are not going to put a rear-setback number on a marketing page and have the Zoning examiner contradict it.

What the Town does state plainly: an ARU must comply with the Milton Zoning By-law, the Ontario Building Code and the Fire Code. The Fire Code reference is not decorative — separation and egress drive real design decisions on a detached unit.

How we build it

Modular crane-in — we pour the slab and run utilities while the unit is built on a factory floor. One crane day, less weather risk. Crane access from the street or a neighbouring yard has to work, and we tell you if the pick does not work before you pay for a module.

Full custom — foundation-up on the lot. Better for irregular lots and for matching an existing house closely.
