Short answer: Yes, you can build a garden suite in Oakville, and you need a building permit and a zoning certificate of occupancy to do it. The Town calls a garden suite a detached additional residential unit. A lot can have one, plus one attached unit at most. Under By-law 2014-014 it must sit at least 1.2 metres from the interior side and rear lot lines.

Which by-law applies

Oakville has two comprehensive zoning by-laws. By-law 2009-189 applies to North Oakville, north of Dundas Street and south of Highway 407. By-law 2014-014 applies to the rest of the town. Both allow detached additional residential units, but the wording differs, so confirm which by-law covers your lot before you draw anything.

Zoning rules for a detached unit

  • Where it can go: in an accessory building associated with a detached, semi-detached or townhouse dwelling. By-law 2014-014 also lists linked dwellings.
  • How many: two attached additional units, or one attached unit and one detached unit. You cannot have two detached suites. A basement apartment does not stop you from adding one garden suite.
  • Setbacks: under 2014-014 s. 4.1.4 (By-law 2026-088), at least 1.2 metres from an interior side lot line or a rear lot line. In North Oakville, setbacks are checked against your zone.
  • Entrance: the suite's entrance and exit cannot face a yard less than 1.0 metre wide.

Height, lot coverage and other limits depend on your zone. We check them on the survey and do not quote a single town-wide figure. Province-wide context is in additional residential units in Ontario, and you can compare Oakville with its neighbours in the GTA garden suite rules comparison.

Permit steps

  1. Check the lot. Confirm the by-law and zone, the survey, servicing, trees and crane access. Start with our free feasibility check.
  2. Prepare drawings. The Town's accessory unit permit guide asks for digital drawings, scaled and flattened: a site plan, elevations, floor plans with fire separations and details, an HVAC design and a water services calculation. It recommends a BCIN-qualified designer, architect or engineer.
  3. Apply online. Submit through the Town's building permit application process and pay the $100 pre-screening fee.
  4. Get zoning sign-off. A separate zoning certificate of occupancy approval is required, and you apply for it online.
  5. Build and inspect. Inspections continue through occupancy.

Other approvals

  • Conservation Halton: required when the project includes excavation and the property backs onto green space, a river bed or a wetland.
  • Heritage: properties on the Town's heritage register may need heritage approval.
  • Trees: trees on your lot, your neighbour's lot or the municipal right of way may need protection. Removing some private trees needs a permit.
  • Site alteration: digging, excavating or changing the grade may need a separate development engineering permit.

Fees, charges and taxes

The minimum building permit fee is $200, and the Town calculates the total at pre-screening based on the project's size, type and use. The $100 pre-screening fee is non-refundable, it is credited toward the permit, and resubmissions are charged again. The Town says development charges may apply to some accessory units. Ontario's Development Charges Act (s. 2(3.2) and (3.3)) generally exempts one unit in an ancillary building, so confirm with the Town's Development Finance team. New construction can also trigger a supplementary property tax assessment from MPAC.

FAQs

Yes. The Town of Oakville requires a building permit for any building over 10 square metres, and for a building of any size that contains plumbing. A garden suite has a kitchen and a bathroom, so it always needs one. It also needs a separate zoning certificate of occupancy approval.
