Short answer: Yes, you can build a garden suite in Brampton, but it starts at Planning, not Building. You first get a Custom Home – Garden Suites Review ($530 fee plus a $5,000 security deposit), then a building permit that also registers the unit. In most residential zones the suite is capped at 35 square metres and 4.5 metres high. The Garden Suite Grant Program closed on July 21, 2025.

Brampton's garden suite rules
The City of Brampton defines a garden suite as an additional residential unit ancillary to a single detached, semi-detached or street townhouse dwelling. It is a building detached from the house, in the rear or interior side yard, and it can be freestanding or attached to a detached private garage. The City's general provisions are:
- Location: rear or interior side yard only.
- Size: 35 m² in residential zones; 80 m² in Hamlet, Estate or Agricultural zones.
- Setbacks: 2.5 m from the rear lot line, 1.8 m from the side lot line, 3.0 m from the house.
- Height: the lesser of the house's height or 4.5 m (7.5 m in Hamlet, Estate or Agricultural zones).
- Access: a 1.2 m unobstructed pedestrian path to the suite's main entrance.
- Not allowed: balconies and rooftop patios.
Brampton's ARU Search Tool gives site-specific information for your address, but the City notes it does not replace the approval process. A 35 m² single-storey footprint suits a factory-built module; see modular vs site-built. For build options in Brampton, go to garden suites in Brampton.
The four-step process
- Planning review. Submit the Custom Home – Garden Suites Review form and drawings through BramPlanOnline. Urban Design reviews against the Garden Suite Guidelines, Zoning checks compliance, and Development Engineering approves the servicing and grading plan. Fee: $530 under User Fee By-law 380-2003, plus a $5,000 security deposit.
- Building permit and registration. Apply online through the Brampton Building and Business Portal with the completed Application for Registration and Construction of a Garden Suite, the Planning-approved drawings, a $200 registration fee, the $2,004.10 permit fee and a legal survey.
- Education development charges. These are collected before the permit is issued, at the school board rate in force at that time.
- Construction and inspections. Registration is finalized when occupancy is granted, and you no longer email the ESA certificate. If an inspection fails twice, recall fees apply to each later inspection.

Conservation, surveys and inspections
- Conservation authorities: on lands regulated by Credit Valley Conservation or TRCA, the unit needs their approval, and the permit will not proceed without it.
- Survey: the legal survey must be legible and signed by the surveyor. The City does not keep surveys for all properties.
- Unregistered units: the City lists administrative penalties of $750 to $1,200 for failing to register an ARU.
Grants and development charges
The Garden Suite Grant Program closed on July 21, 2025, and there is no City garden suite grant now. Brampton's Development Charge Reduction Program reduces the City's portion of residential development charges by 50% for eligible dwelling types from March 31, 2026 to March 30, 2029. The City says it is not a direct grant, other charges still apply, and Region of Peel development charges are not reduced by it. Ontario's Development Charges Act (s. 2(3.2) and (3.3)) generally exempts one unit in an ancillary building, so confirm with the City which charges apply to your suite.
